The European Union has postponed its planned social media age verification measures, citing technical and legal complexities, while the United Kingdom presses forward with its landmark Online Safety Act. This divergence marks a critical juncture in the regulation of digital platforms, with implications for child safety, privacy, and the operational burden on tech companies.
Brussels had intended to require social media platforms to verify users' ages, aiming to protect minors from harmful content. However, internal documents seen by this correspondent reveal that the European Commission has shelved the proposal indefinitely, after member states raised concerns about feasibility and potential conflicts with data protection laws under the General Data Protection Regulation (GDPR). The delay underscores the challenge of implementing age checks without infringing on privacy or enabling surveillance.
Meanwhile, the UK’s Online Safety Act, which received royal assent in October 2023, is being implemented in phases. For context, a 2023 Ofcom report found that 60% of children aged 8-17 have social media accounts, and one in five have encountered cyberbullying or inappropriate content. These statistics, coupled with mounting public pressure, have driven the UK's haste. However, technical solutions such as age estimation via AI or government ID integration carry risks of bias and exclusion.
The EU’s delay may give it an opportunity to learn from the UK’s implementation. Yet, as the UK speeds ahead, a patchwork of regulations is emerging. Tech companies could be forced to tailor age checks for each jurisdiction, raising compliance burdens.
